Contest Rules (short and sweet)
DEADLINE: October 31, 2009
HOW TO ENTER and HOW TO WIN:
(a) Enter the contest by submitting a video or photo of you and your man kissing. Every month, the best photo (as chosen by our judges) will receive a webcam. On November 9, 2009, the best video (as chosen by our judges) will be awarded the cool $10,000 grand prize!
(b) Do it now and do it often! The submission deadline of 12:00AM PST, October 31, 2009.
(c) Keep it clean(ish)! If your video and/or photo submission is approved, we'll post it to this site and notify you by email. What to avoid? Exposed genitals, explicit and offensive material—use common sense. You need permission from everyone in the entry to use their image, and they've all got to be over 18.
(d) Feel good about yourself! Interactive Male is donating $5 for every eligible video and $1 for every eligible photo to Marriage Equality USA, to support legally recognized marriage for everyone, whatever their gender identity or sexual orientation. Your entry can help us change the world!
(e) Spread the word! This contest is about Community Involvement so Involve Your Community! Our judges care about performance, so tell your boyfriend, your husband, your friends, family, co-workers—even strangers in the street—to rate your entry, comment on your entry, post it on Facebook and share it with friends!
P.S. Remind them that comments can’t include any contact info (like full names, phone numbers, email addresses, websites, etc.) or inappropriate, nasty language. We check every post before it goes live, and you’ve got to obey to play!
(f) Watch this space! Monthly webcam winners will be announced at the start of each calendar month between April 2009 and October 2009. The Grand Prize Winner will be announced November 9, 2009.

Official Contest Rules (the legal mumbo-jumbo)
By submitting your video and/or photograph to the BIG GAY KISSTM Contest, you acknowledge that you understand and agree to these rules governing the BIG GAY KISSTM Contest, which may be amended by Sponsor at anytime. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER THE BIG GAY KISSTM CONTEST OR TO WIN A PRIZE. Questions, clarification, or comments about these BIG GAY KISSTM Contest rules can be sent by email.
1. WHO CAN SUBMIT: Subject to the additional restrictions below, Interactive Male invites submissions from all legal U.S. and Canadian residents who are 18 years of age or older at the time that the video or photograph was taken, excluding U.S. residents of Rhode Island, Puerto Rico, Alaska, and Guam, and Canadian residents of Quebec.
2. SPONSORS/ADMINISTRATOR: The Sponsor of this Contest in the United States is Teligence (U.S.), Inc. with a mailing address of 1685 H Street, Suite 615, Blaine, WA 98230, and in Canada is Teligence (Canada) Ltd. with a mailing address of 700 - 1045 Howe Street, Vancouver, BC V6Z 2A9.
3. CONTEST PERIOD: The BIG GAY KISSTM Contest begins March 19, 2009, and submissions will be accepted up to October 31, 2009.
4. HOW TO SUBMIT: To submit your video or photograph, visit www.BigGayKiss.com and/or www.InteractiveMale.com to complete the BIG GAY KISSTM Contest submission form (normal Internet access and usage charges imposed by your online service will apply). You must (i) provide your age and personal identity verification upon request, by providing a clear copy or digital scan of government issued photo ID; (ii) own the copyright or have secured the right to distribute the submitted video or photograph without restriction, including the right to upload this video or photograph for this Contest; (iii) know the names and addresses of all identifiable persons in your video or photograph (all of whom must be at least 18 years of age or older at the time that the video or photograph was taken); and (iv) have obtained the express consent of all identifiable persons in your video or photograph to the submission of such video or photograph to this BIG GAY KISSTM Contest. The video or photograph must be sharp or of good viewable quality (i.e. not blurry, out of focus, color manipulated, etc.). The Sponsor is not responsible for incomplete, lost, illegible, misdirected, unreadable, or late entries, or any failure to receive or delay in receipt of submissions. Duplicate entries of the same video or photograph will be disregarded and false and/or deceptive entries or acts shall render entrant ineligible. Submissions that are incomplete, illegible, or otherwise not in compliance with these rules will not be considered for a prize and will be promptly removed from the Sponsor's website. There is no limit on the number of videos or photographs that an entrant may submit. All entries will receive the same consideration. All videos and photographs submitted, including all uploaded content, become the sole property of the Sponsor and will not be returned or acknowledged.
5. CONTENT OF VIDEOS OR PHOTOGRAPHS: All videos or photographs must show two or more men kissing each other (no children or women kissing or being kissed will be accepted), on any place on the body other than in the genital area. The faces of the people kissing must not be obscured by masks, make-up, or technical effects. The videos or photographs must not show any frontal nudity, erections under clothing, or any overtly graphic visuals. Sponsor reserves the right, in its sole discretion, to reject any videos or photographs for whatever reason and to disqualify any submission that does not comply with these rules, that is alleged to infringe on any third party's intellectual property rights, or that Sponsor deems obscene, offensive, indecent, or otherwise inappropriate.
6. VIDEO SUBMISSIONS: Video submissions must be between 10 seconds and two minutes in length (the kiss itself does not need to last the duration of the video). Full or recognizable faces of all persons on the video must be displayed or shown toward the camera at some point during the video presentation. The names and addresses of all persons kissing in the video must be submitted upon request by Sponsor. The best formats for uploading the video are as follows:
- Video Format: WMV, AVI or MPEG
- Aspect Ratio: Native aspect ratio without letterboxing (examples: 4:3, 16:9)
- Resolution: 640x360 (16:9) or 480x360 (4:3) recommended
- Audio Format: MP3 or AAC preferred
- Frames per second: 30
- Maximum file size: 40MB
7. PHOTOGRAPH SUBMISSIONS: Photograph submissions may be digital (saved in JPG, GIF, and PNG format and less than 2MB in size), or digitally scanned snapshot, or scanned Polaroid. No slides, transparencies, or photocopies will be permitted. No mail in entries will be accepted. All photographs receive the same consideration.
8. SELECTION OF VIDEO AND PHOTOGRAPH PRIZE WINNERS: For video submissions, at the end of the Contest Period, Sponsor shall select one (1) grand prize winning video and four (4) runner-up winning videos (collectively, the "Winning Videos") from among all completed video submissions received during the entire Contest Period. For photograph submissions, in each calendar month between April 2009 and October 2009, Sponsor will select one (1) photograph from among all completed submissions received during that month as the winning photograph for that month (the "Monthly Winning Photo"). Each Monthly Winning Photo and the Winning Videos will be chosen by a panel of judges (to be selected by Sponsor), on the basis of creativity, composition, originality, fun factor, sexy factor and photo quality. All decisions of the panel of judges and the Sponsor on all matters in relation to this BIG GAY KISSTM Contest shall be final and binding in all respects. The Winning Videos and each Monthly Winning Photo and will be displayed online at www.BigGayKiss.com.
Employees of Teligence (Canada) Ltd., Teligence (US), Inc. and their affiliates (collectively the "Sponsor"), including immediate families and household members of each, are not eligible to win any prizes.
9. PRIZES: The grand prize for the Winning Video shall be a cash prize of USD$10,000.00, and the prizes for the four runner up Winning Videos shall be a cash prize of USD$1,000.00 each. Each cash prize shall be divided amongst and paid directly to all of the identifiable men kissing on each of the respective Winning Videos. No cash prizes shall be paid to any individuals in the Winning Video unless all identifiable men on the Winning Videos have been identified and contacted by the Sponsor. Each individual who has submitted a Winning Photo shall be awarded a webcam, or equivalent prize. All individuals receiving prizes under this BIG GAY KISSTM Contest are responsible for all other expenses not listed as being awarded herein. All federal, state, and local taxes on all prizes are such individual's sole responsibility. Details of all prizes are at Sponsor's sole discretion. No substitution of prizes is permitted, except by Sponsor. Sponsor reserves the right to substitute any prize for one of comparable value for any reason. All individuals receiving any prizes under this Contest will be required to provide government issued photo ID and to Sign a Declaration of Eligibility, Publicity Authorization and Release, as part of their eligibility to collect prizes. Failure to comply with this request or failing to comply with any of these rules will result in disqualification from collecting any prizes. Prizes are non-transferable and no cash equivalent will be awarded.
10. DONATIONS: For each eligible video submitted, Sponsor shall donate USD$5.00, and for each eligible photograph submitted, Sponsor shall donate USD$1.00 to a charity chosen by Sponsor.
11. GENERAL RULES: Individuals selected to win a prize will be notified by email and/or telephone, and all prizes claimed within forty-eight (48) hours of notification will be awarded. No responsibility is assumed by Sponsor for technical, hardware or software malfunctions, telephone failures of any kind, or unavailable network connections, failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this BIG GAY KISSTM Contest which may limit the ability to participate or by any human error which may occur in the processing of submission in this BIG GAY KISSTM Contest. Sponsor reserves the right to suspend, cancel, or extend the BIG GAY KISSTM Contest if a computer virus, bug, or other technical problem corrupts the administration or security of the BIG GAY KISSTM Contest. Sponsor will make two (2) attempts to contact an individual to notify them of his prize within forty-eight (48) hours from the date the winning video or photograph is determined. If Sponsor is unable to reach an individual within this timeframe Sponsor may, in its sole discretion, select an alternate video or photograph. Each individual submitting a video or photograph under this BIG GAY KISSTM Contest grants Sponsor and its affiliated entities and successors, licensees, assigns and agents, the right to use the entrant's name, voice, photograph and likeness without additional compensation, for advertising and promotional purposes, in perpetuity, including promoting and otherwise exploiting future Interactive Male Contests conducted by Sponsor, and in promotion and advertising of Interactive Male in all media, except where prohibited by law. All individuals submitting a video or photograph under this BIG GAY KISSTM Contest further agree to have their names, biographical information and likenesses published on www.InteractiveMale.com and/or www.BigGayKiss.com. By submitting your video or photograph to this BIG GAY KISSTM Contest and/or accepting any prize in connection herewith, you agree to release and hold harmless Sponsor, its respective parents, subsidiaries, affiliates, and each of their respective directors, officers, employees and agents and all others associated with the development and execution of this BIG GAY KISSTM Contest from and against any and all claims, actions, and liability for any injury, losses, damages, disputes and/or disability resulting from participation in this BIG GAY KISSTM Contest and/or award, or from acceptance or use of any prize (including, without limitation, any travel related thereto, and attendance at public events).
Sponsor shall have the right to display online at www.InteractiveMale.com and/or www.BigGayKiss.com any videos or photographs submitted under this BIG GAY KISSTM Contest. Accordingly, by submitting a video or photograph in the BIG GAY KISSTM Contest, you acknowledge and agree that Sponsor shall have the right (without limitation or further compensation to you) to edit, adapt, modify, reproduce, publish, promote, display and otherwise use your photograph or video submission in any way it sees fit, including the right to publish your submission online and in print, as described herein.
